1. Who we are

2. The Service

Baby Tempo is an iOS app that helps adult caregivers:

• create baby profiles;
• log care events (for example sleep, feeding, nursing, pumping, pee, stool, temperature, weight);
• view a daily timeline, summaries, and statistics;
• share a baby profile with other caregivers via invite links; and
• optionally subscribe for premium features after a free trial.

The Service is a personal organisation and coordination tool. It is not a medical device, not a clinical service, and not a substitute for professional healthcare advice.

3. Eligibility and accounts

3.1 Age and capacity

You must be at least 18 years old (or the age of majority in your country, if higher) and able to enter a binding contract.

3.2 Account creation

You create an account using Sign in with Apple or Google Sign-In. We do not offer password-based accounts.

Each identity provider account is separate. Signing in with Apple and later with Google creates two different Baby Tempo accounts unless we later offer account linking.

You are responsible for:

• keeping control of the device and Apple/Google account you use to sign in; and
• activity that occurs under your Baby Tempo account.

3.3 Accurate information

You agree to provide information that is accurate to the best of your knowledge (including baby name and birth/expected date) and to update it when needed.

4. Not medical advice

Important — please read carefully.

Baby Tempo:

• records and displays information you (and invited caregivers) enter;
• may show factual summaries (for example “last feed X hours ago”); and
• may in future show soft, non-committal contextual signals based on logged data.

Baby Tempo does not:

• diagnose conditions;
• prescribe treatment;
• tell you that it is “time” to feed, seek emergency care, or take a medical action; or
• replace midwife, paediatrician, maternity nurse, or other professional guidance.

Always seek qualified medical advice for health concerns. In an emergency, contact local emergency services.

You remain solely responsible for caregiving decisions.

5. Acceptable use

You agree not to:

• use the App unlawfully or for anyone else’s harm;
• create a baby profile or invite caregivers without appropriate authority/consent;
• attempt to access another user’s account or data without authorisation;
• reverse engineer, scrape, overload, or disrupt the Service (except to the extent applicable law allows);
• bypass freemium locks, entitlement checks, or security controls;
• upload malware or abusive content;
• use the App to provide medical advice to third parties as if it were a clinical system; or
• misrepresent your identity or affiliation when contacting support.

We may suspend or terminate access if we reasonably believe these Terms are violated.

6. Baby profiles and caregiver sharing

6.1 Roles

• Admin: creates the baby (or becomes admin by succession) and can invite/revoke caregivers, edit baby info, and remove the baby (subject to App rules).
• Editor: joins via a valid invite and can log/edit/delete care events for that baby.

Admin and editors share the same care record for that baby.

6.2 Invites

Admins can create a single-use invite link that expires after 24 hours. The link is not pre-bound to a specific email address.

Anyone with a valid unused link who signs in may gain editor access. You are responsible for whom you share invite links with.

Expired or already-used links do not grant access.

6.3 Leaving, revocation, and succession

• An admin may revoke an editor.
• Any caregiver may leave a baby.
• If an admin leaves and other caregivers remain, the earliest remaining caregiver may become admin.
• If the last caregiver leaves, the baby profile is archived/removed according to App behaviour.

6.4 Shared responsibility for content

Care events created by any caregiver on a baby are visible to all current caregivers on that baby. You understand that invited caregivers can change or delete events according to their permissions.

7. Free trial and subscriptions

7.1 Free trial

New baby profiles may receive a 10-day free trial of full logging features, starting when birth is confirmed in the App (or according to the trial rules shown in-product). Exact trial behaviour is described in the App.

7.2 Free tier after trial

After the trial, unless premium access applies, some event categories may be locked. Sleep-related basics (for example nap, wake up, bed time) may remain available on the free tier as shown in the App.

7.3 Premium plans

Premium may be offered as:

• auto-renewing monthly subscription;
• auto-renewing yearly subscription; and/or
• lifetime one-time purchase,

at the prices shown in the App at the time of purchase (prices may vary by storefront and taxes).

7.4 Per-baby entitlement sharing

Premium unlock for locked categories is evaluated per baby. If a baby’s admin has an active trial or paid entitlement, all caregivers on that baby may receive full feature access for that baby. An invited editor does not need their own subscription for that baby while the admin’s entitlement is active.

If admin entitlement lapses, locks may apply again for all caregivers on that baby.

7.5 Apple billing

Purchases are processed by Apple via In-App Purchase / StoreKit. Payment, renewal, cancellation, refunds, and billing support are primarily handled under Apple’s terms and your App Store account settings.

Manage or cancel auto-renewing subscriptions in your Apple ID subscription settings. Deleting the App or your Baby Tempo account does not automatically cancel an Apple subscription.

7.6 Restore purchases

The App may offer Restore Purchases for eligible prior purchases (including subscriptions, lifetime purchase, or legacy paid-app entitlements where applicable).

7.7 Changes to pricing and plans

We may change prices or plan structures prospectively. Apple will present applicable prices at purchase. Material changes will be reflected in the App Store product information.

8. Licence to use the App

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Baby Tempo on Apple devices you own or control, as permitted by the App Store Terms of Use.

We and our licensors retain all rights, title, and interest in the App, branding, software, and content we provide (excluding your care data).

You must not copy, modify, distribute, sell, or lease any part of our Service except as expressly allowed.

9. Your content

“Your Content” means baby profiles, care events, and other information you submit.

You retain rights in Your Content. You grant us a worldwide, non-exclusive licence to host, store, process, transmit, display, and back up Your Content solely as needed to operate, maintain, secure, and improve the Service and as described in the Privacy Policy.

You represent that you have the rights needed to submit Your Content and to share it with invited caregivers.

We may remove content that violates these Terms or applicable law.

10. Privacy

Our processing of personal data is described in the Privacy Policy.

By using the App, you acknowledge that caregivers you invite can access the shared baby record.

11. Third-party services

The App relies on third parties, including:

• Apple (Sign in with Apple, App Store, payments, device features such as Live Activities);
• Google (Google Sign-In, when enabled);
• cloud hosting and database providers; and
• optional analytics tooling.

Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services we do not control.

12. Availability and changes

We aim to keep Baby Tempo available and reliable, but we do not guarantee uninterrupted or error-free operation. Features may change, be limited by freemium rules, or be discontinued.

We may update the App and these Terms. Continued use after an update constitutes acceptance of the revised Terms, except where applicable law requires additional consent.

If you do not agree to updated Terms, stop using the App and delete your account.

13. Account deletion and termination

You may delete your account via in-App data deletion controls or by contacting baby-tempo@fooshi.co.

We may suspend or terminate your access if:

• you breach these Terms;
• we must do so for legal or security reasons; or
• we discontinue the Service (with reasonable notice where practicable).

Effects of deletion on shared babies are described in the Privacy Policy and in-App behaviour (shared records may continue for remaining caregivers).

14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• the App will meet your specific caregiving or medical needs;
• summaries or future soft predictors will be accurate or complete; or
• the App will be free of bugs, delays, or security vulnerabilities.

Nothing in these Terms excludes mandatory consumer protections that cannot be waived under applicable law.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR CARE DECISIONS MADE IN RELIANCE ON THE APP;
• OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE APP IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) EUR 50.

These limits do not apply to liability that cannot be limited under applicable law (for example death or personal injury caused by negligence where such limitation is prohibited, or fraud).

Because Baby Tempo is not a medical service, you agree that caregiving and health decisions remain yours (and your healthcare professionals’), not ours.

16. Indemnity

To the extent permitted by law, you agree to indemnify and hold Fooshi harmless from claims arising out of:

• your misuse of the App;
• Your Content;
• caregiver invites you create or accept; or
• your breach of these Terms,

except to the extent caused by our wilful misconduct or where indemnity is not permitted.

17. App Store / Apple-required terms

If you downloaded the App from the Apple App Store, you acknowledge that:

• these Terms are between you and Fooshi, not Apple;
• Apple has no obligation to provide maintenance or support for the App;
• in the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation;
• Apple is not responsible for addressing claims relating to the App or your possession/use of it, including product liability, legal/regulatory claims, and consumer protection claims;
• in the event of a third-party claim that the App infringes intellectual property rights, Fooshi (not Apple) is responsible for investigation, defence, settlement, and discharge as required by these Terms;
• Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you; and
• you must comply with applicable third-party terms when using the App.

18. Governing law and disputes

These Terms are governed by the laws of [country / EU member state — to be completed], without regard to conflict-of-law rules, except that mandatory consumer protection laws of your country of residence continue to apply.

Courts of [city / country — to be completed] shall have jurisdiction, subject to any mandatory rights you have to bring proceedings in your local courts as a consumer.
